  • Scope of the General Terms and Conditions
    • These General Terms and Conditions (hereinafter referred to as "Terms and Conditions ") apply exclusively to contracts concluded with consumers via www.viconawear.com with Vicona Wear eU, owner Julian Ebner, B.Sc., Rupertiweg 6, 5324 Faistenau, Austria, (hereinafter referred to as "Vicona "). The offers on our website are aimed exclusively at consumers, i.e. any natural person who concludes the purchase for a purpose that cannot be attributed to their commercial or independent professional activity. Sales to entrepreneurs/companies are only possible upon personal inquiry.
    • These Terms and Conditions therefore apply to all offers, deliveries, and services provided by Vicona, regardless of the means of distance communication used to conclude the contract. Only orders placed using the specified system can be processed in the online shop. By registering as a customer and placing an order, you acknowledge and agree to these Terms and Conditions. Vicona reserves the right to unilaterally amend its Terms and Conditions at any time.
    • Without the customer's consent to these Terms and Conditions, a purchase is not possible. The contract language is German.

  • Conclusion of contract and delivery
    • Vicona accepts orders from private customers (consumers) with their habitual residence (billing address) within the European Union and only in commercially acceptable quantities. However, deliveries are only possible within Austria, Germany, and Italy.
    • Customers ordering through www.viconawear.com must therefore provide a delivery address in Austria, Germany, or Italy where they can pick up the goods themselves or arrange for them to be picked up. Delivery to other countries is not possible.
    • The presentation of the products in the online shop does not constitute a legally binding offer, but merely an invitation to order.
    • By clicking the " Buy/order for a fee " button, the consumer places a binding order for the goods listed on the order page. The purchase contract is concluded when Vicona accepts the order by sending an order confirmation via email immediately after receiving your order.
    • Delivery time is up to 10 business days. Any deviations will be indicated on the respective product page.
    • Delivery and shipment will be carried out by DPD or other logistics service providers from the warehouse to the shipping address you have specified.
    • Please note that if you pay in advance (reservation), the ordered goods will be delivered as soon as we have received payment of the full purchase price and any shipping costs.

  • Prices and shipping costs
    • The prices stated at the time of the order are in the respective national currency and represent the final prices, i.e., including statutory VAT and excluding shipping costs. Obvious pricing errors remain unaffected. The goods remain the property of Vicona until the purchase price has been paid in full. Unless otherwise stated, the replacement prices are the lowest prices within the last 30 days prior to the price reduction.
    • In addition to the stated prices, we charge a flat rate of €4.99 per order for delivery within Austria, including VAT. Shipping costs will be clearly communicated to you on the product pages, in the shopping cart system, and on the order page. For orders over €150.00, we deliver free of charge within Austria. For deliveries to Germany or Italy, we charge a flat rate of €8.99 per order. Shipping costs will be clearly communicated to you on the product pages, in the shopping cart system, and on the order page.
    • The costs apply per order. The amount includes standard packaging and delivery costs. For partial shipments, the flat rate is charged only once.

  • payment
    • We generally offer the following payment methods: advance payment, credit card, invoice with Klarna, eps online transfer, ShopPay, and GooglePay. We reserve the right to refuse certain payment methods for each order and to refer to other payment methods. Please note that we only accept payments from accounts within the European Union (EU). You are responsible for any fees associated with a money transaction.
    • If you purchase by credit card, your credit card account will be charged when we ship your order.
    • When you purchase on account with Klarna, you receive the goods first and you always have a payment period of 14 days.
    • You agree to receive invoices and credit notes exclusively in electronic form.

  • Promotional vouchers and their redemption
    • Promotional vouchers are vouchers that cannot be purchased, but which we issue as part of advertising campaigns with a specific period of validity.
    • Promotional vouchers can only be redeemed during the specified period and only once per order. Individual items may be excluded from the voucher promotion. Promotional vouchers cannot be used to purchase gift vouchers. Please note that promotional vouchers may be subject to a minimum order value.
    • The value of the goods must be at least equal to the amount of the promotional voucher. Any difference to a higher value of the goods can be settled using the offered payment method. The value of a promotional voucher is neither redeemable in cash nor bears interest. The promotional voucher will not be refunded if the goods are returned in whole or in part.
    • Promotional vouchers can only be redeemed before completing the order process. Retroactive crediting is not possible. The promotional voucher cannot be transferred to third parties. Multiple promotional vouchers cannot be combined unless we have agreed otherwise.

  • Retention of title
The goods remain the property of Vicona until full payment has been made.
  • Statutory right of withdrawal

When you purchase Vicona items, you have a statutory right of withdrawal.

Cancellation policy:
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period shall be 14 days from the day on which you or a third party other than the carrier designated by you takes possession of the goods.
To exercise your right of withdrawal, you must inform Vicona of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post, fax, or email). You may use the following model withdrawal form, but this is not mandatory.

To comply with the cancellation period, it is sufficient that you send the notification of the exercise of the right of cancellation before the cancellation period has expired.

Consequences of revocation
If you cancel this contract, we will refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), promptly and at the latest within 14 days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged any fees for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods to us or to (where applicable, the name and address of the person authorized by you to receive the goods) promptly and in any event no later than 14 days from the date on which you notify us of the cancellation of this contract. This deadline is met if you send the goods before the expiry of the 14-day period.
You shall bear the direct costs of returning the goods.
You only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods which is not necessary to check their quality, properties and functioning.
  • Warranty/Manufacturer's guarantee
    • Statutory warranty rights apply to the items available in the online shop.
    • No warranty claim shall apply in the event of defects in the product caused by the customer.
    • Regardless, as a manufacturer, we may offer our own warranty for our products. If such a warranty exists, you can find further details in the documentation accompanying the respective product.
    • Each customer is only authorized to maintain one Vicona account at a time. We reserve the right to delete multiple registrations.

  • Defects

Obvious damage to the packaging must be reported to the shipping company immediately, and acceptance of the shipment must be confirmed only "subject to reservation." Please notify us immediately of any damage to the goods.

  • Data protection
    • The protection of your personal data is of utmost importance to us. We therefore process your data exclusively in accordance with the statutory provisions (GDPR, DSG2000, Telecommunications Act 2003). In this privacy policy, we inform you about the most important aspects of data processing on our website.
    • Users who no longer wish to receive our newsletter or promotional emails should click on a link called "Unsubscribe" which is included in all emails sent by Vicona.

  • Terms of Use/Data Protection Declaration of Consent

Use of this website is subject to the following conditions:

    • Users of this website agree to these rules and agree that Vicona cannot be held liable under any circumstances for the use of this website.
    • All content (text, images, sound files, animations, and videos) and the design of the Vicona website are provided solely for the personal information of our customers and are protected by copyright. Excerpts may only be copied, saved, and further processed for private purposes. Commercial use requires express written permission.
    • Use of the website is at your own risk. Vicona assumes no responsibility for the content of third-party websites referenced via hyperlinks. Vicona hereby expressly distances itself from all content of all linked third-party websites and does not adopt this content as its own. This declaration applies to all displayed links and to all content of the pages to which links lead. All data on this website is protected by copyright as databases and database works.

  • Applicable law
    • Austrian substantive law shall apply to this contract; the applicability of the UN Convention on Contracts for the International Sale of Goods is excluded.
    • For all legal actions brought against a consumer who has their domicile, habitual residence, or place of employment in Austria, due to disputes arising from this contract, the courts in whose district the consumer has their domicile, habitual residence, or place of employment shall have jurisdiction. For consumers who do not have a domicile in Austria at the time the contract is concluded, the statutory places of jurisdiction apply.

  • Severability clause
    • The invalidity of individual provisions of these Terms and Conditions shall not affect the validity of the remaining provisions. The contracting parties are obligated to agree on a new provision that most closely approximates the purpose of the invalid provision.
    • The headings of the provisions contained in these Terms and Conditions of Sale are for convenience only and shall not be used to interpret them.

  • Alternative dispute resolution procedures
    • The EU Commission has created an internet platform for online dispute resolution (Online Dispute Resolution Platform). The "ODR Platform" serves as a contact point for the out-of-court settlement of disputes concerning contractual obligations arising from online sales contracts. The platform gives consumers the opportunity to resolve disputes related to their online orders without initially involving a court.     • We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
